Queensland Registry of Births, Deaths and Marriages

1. Definitions and interpretations: In this agreement -

  • BDM means the Registry of Births, Deaths and Marriages, a division of the Department of Justice and Attorney-General, on behalf of the State of Queensland.
  • BDM provisions means the provisions set out in these clauses 1 to15.
  • BDM webpages means the webpages located on the DJAG Website which are dedicated to the Registry of Births, Deaths and Marriages and which contain the equipment, programs and services provided to allow you to locate historical life event records or details and to order an historical image online or to complete online an application form for an historical record.
  • we and us means BDM.
  • you means the legal entity or entities using the BDM webpages.
  • historical record means a digital image of an original historical life event record held by BDM or a fresh certificate of a historical life event details recorded by BDM.
  • DJAG website means the website of the Department of Justice and Attorney-General.
  • SSQ means Smart Service Queensland, a business area within the Queensland Department of Science, Information Technology, Innovation and the Arts.
  • SSQ website means a website that is owned and operated by SSQ and through which payment of your request for an historical record will be processed.

2. Terms of agreement: This agreement consists of the BDM provisions, the Privacy, Disclaimer and Copyright statements on the DJAG website and the SSQ website provisions. Your access to the BDM webpages is conditional upon your acceptance and compliance with the terms of this agreement. Your access to and use of the BDM webpages constitutes your agreement to the terms of this agreement. See the Privacy ( https://www.qld.gov.au/legal/privacy/ ) , Disclaimer ( https://www.qld.gov.au/legal/disclaimer/ ) , and Copyright ( https://www.qld.gov.au/legal/copyright/ ) statements on the DJAG website which form part of this agreement. We have the right to change or discontinue the provisions or any feature on the BDM webpages at any time including pricing and access to particular historical records.

3. SSQ website terms: To pay for an historical record, which you order, you will be transferred to the SSQ website. By using the SSQ website you will be agreeing to the terms and conditions contained on that site. See SSQ terms and conditions. ( https://www.qld.gov.au/legal/disclaimer/ )

4. Digital image: Upon payment for an historical record in the form of a digital image you are given the right to access, view and download the purchased image through the BDM webpages for a period of 14 days from the date of purchase.

5. Linked websites disclaimer: We make no representations about any other website which you may access through the BDM webpages, including the SSQ website. Please understand that SSQ is independent from the BDM webpages, and that we have no control over the content on, or availability of, that website.

6. Liability and indemnity: To the maximum extent permitted by law, you agree that BDM is not liable to you, or any third party who claims against you, for any direct, indirect, incidental or consequential loss or damage (including liability in negligence) that may occur through the use of the BDM webpages or an historical record (for example, without limitation, inaccurate or incomplete information) and you agree to indemnify BDM against all claims for loss or damage and any other liability arising out of your use of the BDM webpages or an historical record. 7. Copyright: To the extent to which copyright subsists in an historical record, BDM asserts its rights as the copyright owner. You do not acquire ownership of any intellectual property rights in any part of any historical record by virtue of this agreement. Except for purposes permitted by the Copyright Act 1968, BDM does not grant you permission to resell, reproduce, swap, share, trade, copy, adapt, publish, distribute or commercialise an historical record. 8. Use of historical records: You agree to use any historical record which you purchase from BDM only for your personal and non-commercial purposes.

9. Your information technology: The BDM webpages and the DJAG website use Internet technology. BDM is not responsible to you for any problems with your computer hardware and software, computer settings, printer hardware and software or your ability to download, store or print a purchased historical record or any problems with your telecommunications services, or Internet Service Provider.

10. Incorrect selection: BDM will not refund any fee or charge paid for the purchase of any historical record that you have selected and ordered except where BDM has supplied a different record to the record ordered by you or where a refund is required by law.

11. Legibility: Where historical records you purchase are provided in the form of digital images of original historical life event records held by BDM, the images provided to you are scanned copies of the original records and represent a true image of the original register record. BDM therefore cannot guarantee the legibility of any register images supplied to you as part of your purchase. Purchase of an historical record in the form of a digital image is at your own risk.

12. Priority of provisions: To the extent of any inconsistency between the terms which comprise this agreement, the BDM provisions will prevail over the DJAG website terms and the SSQ website terms, and the DJAG website terms will prevail over the SSQ website terms.

14. Governing Law: This agreement shall be governed by and interpreted in accordance with the laws of the State of Queensland, Australia.

15. Whole Agreement: This agreement constitutes the whole agreement between you and us, and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing.

16. Waiver: None of the provisions in this agreement will be taken to be waived except by written notice signed by you and us.
